On Thursday, June 22, 2017, Senate Majority Leader Mitch McConnell of Kentucky released a 142-page healthcare “Discussion Draft” of legislation, called the Better Care Reconciliation Act of 2017 (BCRA), which is the Senate version of the Affordable Care Act (ACA) “repeal-and-replace” legislation American Health Care Act (AHCA) passed by the U.S. House of Representatives last month. An updated “Discussion Draft” of the BCRA was released on June 26, 2017 with the intention of calling for a vote on the bill before the Fourth of July recess. However, Senator McConnell had to delay that vote after it became clear that it would not get the 51 votes required under the Budget Reconciliation rules to pass. On Wednesday July 5, 2017, Governor Jay Inslee signed a bill into law that will make Washington the fifth state in the nation to require paid family and medical leave for employees. The bill is set to take effect on 1/1/2020 and provides the most generous benefits of its kind in the country. This will have implications for employers of all sizes. Overview Under the new law, Washington workers will be entitled to take up to 12 weeks of paid leave for the birth or adoption of a child, to care for a severely ill family member, or to deal with the worker’s own serious health condition.
